Do Kwon, co-founder of Terraform Labs, has agreed to plead guilty to wire fraud and conspiracy to defraud. The decision marks a turning point in a prolonged legal battle tied to the 2022 collapse of Terra USD, an event that erased around $40 billion in market value.
Kwon, aged 33, confirmed the plea agreement in court, waiving his right to a trial. He also acknowledged that the charges could carry a prison sentence of up to 25 years.
Terra USD Collapse
The plea agreement came after U.S. District Judge Paul Engelmayer in New York noted the court had been told of a possible plea change. Until now, Kwon had maintained his innocence in the criminal case.
That case began in March 2023 when American prosecutors brought charges against Kwon. The indictment listed multiple counts, including commodities fraud, securities fraud, wire fraud, market manipulation, and money laundering.
Prosecutors said the allegations arose from the failure of Terra USD, a cryptocurrency designed to hold a steady price through automated trading mechanisms. This system relied on its link to Luna, Terraform’s governance token, to maintain the stablecoin’s value.
Its collapse caused widespread financial distress, pushing several major crypto businesses into insolvency. It became one of the most significant failures in digital asset history.
Kwon Faces Legal Battles
Kwon’s arrest took place in Montenegro in March 2023, where authorities accused him of using falsified travel documents. His extradition to the United States occurred in December after competing requests from both the U.S. and South Korea.
In a separate matter from the criminal proceedings, the U.S. Securities and Exchange Commission filed civil charges in February 2023. The agency accused Kwon and Terraform of misleading the public and violating federal securities laws.
That civil trial began in late March without Kwon present. In April, a jury ruled that Kwon and Terraform committed civil fraud over false statements tied to the company’s digital assets.
The guilty plea in the criminal case is expected to conclude one chapter of Kwon’s legal challenges. However, sentencing in the U.S. and any further international proceedings remain pending.
